FAIR PROCEDURES IN DISCIPLINARY PROCEEDINGS

Individual employees, managers and union representatives at all levels are finding it increasingly difficult to organise, navigate and ensure that the principles of fair process and natural justice are enshrined in the procedures and practices in which they are engaged. Individual rights cases, grievances and disciplinary investigations have become increasingly ‘legalised’. Challenges to outcomes make for headline setting cases in the courts of law.

Ampersand associates and staff monitor and review developments and challenges to case handling methods. Recently an eminent Senior Counsel participated in one of our review sessions and prepared our workshop notes on the most appropriate in-house procedure to be employed in a range of issues which can and do arise. The paper will be updated from time to time.
